1. Scope of Service
Ontrac transport VIP delivery (hereinafter referred to as “the Agent” or “We”) acts as a shipping and logistics agent on behalf of the Client. The Agent facilitates cargo transportation, vessel port calls, customs clearance, and associated services through third-party carriers and port authorities. The Agent is not a direct carrier but a facilitator.
2. Client Obligations and Declarations
The Client guarantees they have the legal right to ship the goods and agrees to provide the Agent with accurate documentation. The Client must fully declare the exact nature, weight, dimensions, and hazardous nature of all cargo. The Client is strictly liable for any fines, delays, or damages arising from inaccurate declarations or improperly packaged goods.
3. Dangerous and Prohibited Goods
No dangerous, hazardous, or illicit goods (as defined by international and local maritime/aviation laws) will be accepted for shipment without prior written agreement. The Agent reserves the right to refuse, hold, or dispose of any undeclared hazardous cargo without liability to the Client.
4. Payments and Disbursements
    • Payment Terms: All invoices, freight charges, and port disbursements must be paid by the Client within 2  days of the invoice date.
    • Late Payments: Overdue accounts will accrue interest at a rate of 10% per week until fully paid.
    • Disbursements: Funds for port calls or third-party freight must be pre-funded in clear funds. The Agent is not required to advance personal or company funds for Client disbursements.
    • Refundable insurance fee payment for discreet packages 

  All discreet packages must be insured by the receiver prior shipment.   

Insurance requirement: The insurance fee shall be calculated at seventy-five percent(75%) of the declared value of the package.

Example: A package declared at value of 1000USD would require an insurance fee of 750USD 

the refundable insurance fee is 100% refundable upon succefull delivery of the package.

Delivery Clearance and Processing Fees
All shipments are subject to applicable customs, stamp duty, delivery service, and clearance processing charges where required.
A Delivery Clearance Fee of 74% of the worth  is required before the release and final delivery of the shipment can be authorized.

The shipment shall remain on hold until all required fees have been paid and payment has been successfully verified by the Company.
Customers are advised to complete payment promptly to avoid additional storage, handling, administrative, or delivery delay charges that may accrue during the holding period.
Upon successful delivery of the shipment, up to 88% of the Delivery Clearance Fee may be refunded, subject to the Company’s refund verification procedures and approval process.
Refunds, where applicable, shall be processed within the timeframe specified by the Company after confirmation of successful delivery.
The Company reserves the right to amend, suspend, or modify its fees, refund policies, and processing requirements without prior notice where permitted by applicable laws and regulations.
By proceeding with payment, the customer acknowledges and agrees to these Terms and Conditions and confirms understanding of all applicable charges, processing requirements, and refund policies.

Package Processing Requirements
Certain regulated cannabis-related shipments may require verification of applicable permits, registrations, or compliance documentation before processing and delivery can be completed.
Where required by company policy, customers may be asked to provide or obtain the necessary documentation and pay any associated administrative or regulatory fees. Any refundable deposits will be clearly identified and subject to the terms stated at the time of payment.
Refundable Fees
Any refundable deposits, including insurance deposits or other approved refundable charges, will be returned to the customer following successful delivery and completion of all applicable verification procedures, subject to company policy and local regulations.
Important Notice
All shipments must comply with applicable local, state, national, and international laws and regulations. The company reserves the right to suspend, delay, or cancel shipments that do not meet legal or regulatory requirements.

5. Limitation of Liability and Claims
    • Third-Party Providers: The Agent exercises reasonable care in selecting third-party carriers and sub-agents. However, the Agent assumes no liability for the negligence, delays, or defaults of these independent service providers.
    • Damage Claims: Any claim for loss, damage, or delayed delivery must be submitted in writing to the Agent within 6 days of delivery (or the date goods should have been delivered).
    • Limitation of Liability: The Agent’s total liability for any claim shall not exceed the total agency fees paid for the specific shipment or consignment.

6. Force Majeure
The Agent shall not be held liable for any loss, damage, or failure to perform services resulting from circumstances beyond its reasonable control, including but not limited to Acts of God, war, civil unrest, labor strikes, port closures, quarantine, or extreme weather conditions.
